Where there is a conflict between these documents, the following order of precedence applies:

  1. mandatory consumer law;

  2. the Membership Agreement;

  3. the Property Service Schedule;

  4. these Terms & Conditions;

  5. other general information published by JPC.

Nothing in these Terms limits or excludes any legal right or remedy that you have as a consumer which cannot lawfully be limited or excluded.

2. DEFINITIONS

In these Terms:

"Application" means an application submitted for Membership.

"Assessment" means JPC's review and, where required, physical inspection of a property to determine whether it is suitable for Membership.

"Membership Agreement" means the agreement confirming your Membership, price and other applicable terms.

"Membership Year" means the specific 12-month period stated in your Membership Agreement.

"Property" means the residential property identified in your Membership Agreement and Property Service Schedule.

"Property Service Schedule" means the property-specific document identifying the services, areas and limitations included within your Membership.

"Service Visit" means a scheduled visit carried out under the Membership.

"Membership Price" means the total price stated in your Membership Agreement.

"Additional Work" means work requested or required outside the services and areas included in the Property Service Schedule.

3. NATURE OF THE MEMBERSHIP

3.1 The Membership is a defined annual property-maintenance package.

3.2 It is not an unlimited gardening, landscaping, cleaning or property-maintenance service.

3.3 The Membership provides only the services and areas expressly included in your Property Service Schedule.

3.4 The fact that JPC provides a particular service elsewhere does not mean that the service is included in your Membership.

3.5 Any service not expressly included is excluded unless separately agreed in writing.

3.6 Additional Work may be requested by Members and may be quoted separately.

4. MEMBERSHIP PRICE

4.1 The standard advertised price for the 2027 Membership is:

£449 per property per Membership Year.

4.2 The advertised consumer price is the total price payable for the standard Membership, subject to any separately agreed Additional Work.

4.3 Where VAT is legally chargeable, the price shown to consumers will be treated as inclusive of VAT unless expressly stated otherwise.

4.4 JPC will not add compulsory charges after the contract has been entered into unless such charges were properly disclosed and agreed in accordance with applicable law.

4.5 Additional Work will not be carried out for a charge unless you have agreed the applicable price or pricing method.

5. MEMBERSHIP CAPACITY

5.1 JPC intends to limit the 2027 Membership to a maximum of 50 properties.

5.2 This capacity limit exists to allow JPC to schedule work realistically and maintain an appropriate standard of service.

5.3 Submitting an Application does not guarantee a Membership place.

5.4 JPC may decline an Application where, acting reasonably, it considers that the Property is unsuitable for the Membership.

5.5 Reasons for declining an Application may include:

  • Property size;

  • lawn size;

  • excessive number of separate lawn areas;

  • excessive hard-surface area;

  • access difficulties;

  • inadequate access for equipment;

  • parking restrictions;

  • distance from JPC's normal operating area;

  • excessive travel requirements;

  • difficult terrain;

  • safety concerns;

  • unsuitable surfaces;

  • excessive hedge or garden maintenance requirements;

  • the workload associated with the Property being disproportionate to the Membership Price; or

  • available Membership capacity having been reached.

5.6 Where Membership capacity has been reached, JPC may operate a waiting list.

6. APPLICATION PROCESS

6.1 Applications may be submitted through the JPC website or by another method approved by JPC.

6.2 You must provide accurate and reasonably complete information.

6.3 You may be asked to provide photographs of:

  • lawns;

  • driveways;

  • patios;

  • hard surfaces;

  • gates;

  • access routes;

  • parking areas;

  • hedges; and

  • other areas you want considered.

6.4 JPC may rely upon the information and photographs supplied when deciding whether to approve an Application.

6.5 If information is materially inaccurate or incomplete, JPC may reassess the Property.

6.6 An Application is not a contract for Membership.

7. PROPERTY ASSESSMENT

7.1 JPC may carry out an Assessment before offering Membership.

7.2 The Assessment may consider:

  • lawn size;

  • number of lawn areas;

  • surface types;

  • driveway and patio areas;

  • access;

  • gates;

  • steps;

  • parking;

  • travel distance;

  • hedge dimensions;

  • equipment requirements;

  • safety;

  • drainage;

  • existing condition;

  • potential chemical-treatment restrictions; and

  • the overall workload involved.

7.3 JPC may decline to provide Membership following an Assessment.

7.4 An Assessment does not guarantee that a particular service or treatment will ultimately be provided.

7.5 JPC may refuse to work on an area where doing so would present an unreasonable safety, environmental, equipment or property-damage risk.

8. PROVISIONAL APPROVAL

8.1 If JPC considers a Property suitable, JPC may issue a provisional approval.

8.2 Provisional approval does not by itself activate Membership.

8.3 Provisional approval may be subject to:

  • availability;

  • completion of the Membership Agreement;

  • confirmation of the Property Service Schedule;

  • payment of any required deposit;

  • completion of any required customer information; and

  • any other clearly stated pre-condition.

8.4 JPC may specify a deadline by which provisional approval must be accepted.

8.5 If the deadline expires without acceptance or required payment, JPC may release the provisional place and offer it to another applicant.

9. PROPERTY SERVICE SCHEDULE

9.1 Each Member will receive a Property Service Schedule.

9.2 The Property Service Schedule is an important part of the Membership.

9.3 It should identify, where applicable:

  • the Property address;

  • lawn areas included;

  • approximate lawn size;

  • hard surfaces included;

  • approximate hard-surface area;

  • number of power-washing visits;

  • any agreed hedge maintenance;

  • relevant access arrangements;

  • relevant limitations; and

  • other property-specific conditions.

9.4 Only the services and areas identified in the Property Service Schedule are included.

9.5 Approximate measurements are provided for scheduling and operational purposes and do not constitute a guarantee of exact measurement.

9.6 If the Property materially changes after the Property Service Schedule has been agreed, JPC may reassess the affected services.

10. LAWN MAINTENANCE

10.1 The standard Membership includes:

Up to 12 scheduled lawn-cutting visits during the applicable growing season.

10.2 Lawn visits may include:

  • mowing;

  • edging;

  • strimming where reasonably required; and

  • ordinary finishing associated with the lawn cut.

10.3 The Membership does not guarantee that exactly 12 lawn visits will be required or delivered.

10.4 "Up to 12" means that 12 is the maximum included number of lawn visits.

10.5 Lawn visits are scheduled according to seasonal growth, weather, ground conditions, operational requirements and available service routes.

10.6 JPC may reasonably adjust the timing of visits where grass growth, weather or ground conditions make the originally anticipated timing unsuitable.

10.7 JPC is not responsible for the natural growth rate of grass.

10.8 Major lawn restoration is not included.

11. LAWN SERVICES NOT INCLUDED

Unless expressly included in the Property Service Schedule, the Membership does not include:

  • lawn replacement;

  • turf laying;

  • seeding;

  • scarification;

  • aeration;

  • levelling;

  • drainage works;

  • fertilising programmes;

  • moss treatment programmes;

  • weed-control programmes;

  • major weed removal;

  • lawn renovation;

  • removal of large amounts of debris;

  • excavation;

  • landscaping; or

  • repair of damaged lawns.

Such work may be quoted separately.

12. POWER WASHING

12.1 The standard Membership includes:

Up to 2 scheduled power-washing visits per Membership Year.

12.2 Power washing may cover driveways, patios, block paving, tarmac or other suitable hard surfaces expressly identified in the Property Service Schedule.

12.3 The exact areas included will depend upon the Assessment and Property Service Schedule.

12.4 Power washing is intended to clean and improve the appearance of suitable surfaces.

12.5 JPC does not guarantee that all staining, organic growth, discolouration, oil contamination, rust, paint, efflorescence, weathering or other marks can be completely removed.

12.6 Some surfaces may not be suitable for high-pressure cleaning.

12.7 JPC may change the cleaning method, pressure, equipment or treatment where reasonably necessary to reduce the risk of damage.

13. CHEMICAL TREATMENTS

13.1 Where appropriate, JPC may use suitable cleaning chemicals or biocidal treatments as part of a power-washing service.

13.2 The choice of treatment will depend upon the surface, contamination, weather conditions, manufacturer instructions and suitability of the product.

13.3 JPC will use products in accordance with applicable requirements and manufacturer instructions.

13.4 JPC will take reasonable precautions to avoid foreseeable damage to property, vegetation and other nearby areas.

13.5 Customers must inform JPC before treatment of any known:

  • sensitive plants;

  • ponds;

  • water features;

  • fish;

  • animals;

  • drainage concerns;

  • sensitive surfaces; or

  • other circumstances that may affect treatment.

13.6 Customers must keep children and animals away from treatment areas when reasonably requested to do so.

13.7 JPC may refuse a chemical treatment where it considers that the treatment cannot reasonably be carried out safely or appropriately.

14. HEDGE MAINTENANCE

14.1 Routine hedge maintenance is not automatically included in every Membership.

14.2 Where hedge maintenance is agreed, the hedge(s), approximate dimensions and scope of work will be identified in the Property Service Schedule.

14.3 The Membership does not include unlimited hedge cutting.

14.4 The following are normally excluded unless separately agreed:

  • major hedge reductions;

  • hedge removal;

  • large-scale cutting;

  • removal of substantial woody growth;

  • chainsaw work;

  • tree work;

  • disposal of unusually large quantities of waste; and

  • work requiring specialist tree surgery.

14.5 Hedge work may be refused where height, access, condition or other circumstances make the work unsafe.

15. TREES AND TREE SURGERY

15.1 Tree work is expressly excluded from the Membership.

15.2 This includes:

  • tree felling;

  • tree removal;

  • crown reduction;

  • crown lifting;

  • tree pruning;

  • deadwood removal;

  • chainsaw work;

  • stump removal;

  • tree climbing;

  • specialist tree surgery; and

  • emergency tree work.

15.3 Where appropriate, JPC may recommend that the customer obtains advice from a suitably qualified tree professional.

16. OTHER EXCLUSIONS

Unless expressly agreed in writing, the Membership does not include:

  • gutter cleaning;

  • gutter clearance;

  • roof cleaning;

  • roof treatments;

  • fascia cleaning;

  • resealing;

  • re-tarring;

  • tarmac restoration;

  • driveway repairs;

  • patio repairs;

  • block paving repairs;

  • pointing;

  • major landscaping;

  • garden clearances;

  • waste removal beyond ordinary service waste;

  • tree work;

  • structural repairs;

  • drainage repairs;

  • pest control;

  • building repairs;

  • painting;

  • rendering;

  • window cleaning;

  • interior cleaning; or

  • any service not expressly stated in the Property Service Schedule.

17. ADDITIONAL WORK

17.1 Members may request Additional Work.

17.2 Additional Work is outside the £449 Membership unless expressly stated otherwise.

17.3 JPC will normally provide a quotation before carrying out Additional Work.

17.4 Additional Work is subject to availability.

17.5 The fact that a customer is a Member does not guarantee preferential pricing for Additional Work unless JPC expressly offers such pricing.

17.6 Additional Work does not reduce the number of included Membership visits unless expressly agreed.

18. SCHEDULING

18.1 JPC will schedule Membership visits according to operational requirements and reasonable route planning.

18.2 Customers may receive a date, date range or service window.

18.3 Unless expressly agreed in writing, individual visit dates are not guaranteed.

18.4 JPC may rearrange a visit because of:

  • rain;

  • frost;

  • extreme heat;

  • high winds;

  • storms;

  • unsuitable ground conditions;

  • equipment failure;

  • vehicle failure;

  • access problems;

  • safety concerns;

  • chemical-treatment conditions; or

  • other circumstances reasonably outside JPC's control.

18.5 Where reasonably practicable, JPC will rearrange postponed work.

18.6 JPC will not deliberately withhold included services simply to avoid providing them.

18.7 If JPC fails to provide an included Service Visit for reasons within its own control and cannot rearrange it within the Membership Year, JPC will, at the customer's choice, either refund a fair proportion of the Membership Price for that visit or provide an agreed alternative service of equivalent value.

19. SEASONAL SERVICE

19.1 Lawn cutting will generally be concentrated during the growing season.

19.2 Not all months require the same frequency of lawn maintenance.

19.3 JPC may increase or decrease the interval between visits according to grass growth and weather.

19.4 Power-washing visits may be scheduled at appropriate times during the Membership Year.

19.5 A Member cannot require all included visits to be carried out within a short period.

20. CUSTOMER ACCESS

20.1 The customer must provide reasonable access to the Property when a Service Visit is scheduled.

20.2 Customers must inform JPC of:

  • locked gates;

  • access codes;

  • parking restrictions;

  • security systems;

  • animals;

  • vulnerable areas;

  • underground hazards known to them; and

  • other relevant access or safety information.

20.3 If JPC cannot reasonably access the agreed service area, the visit may need to be rearranged.

20.4 Repeated failed access caused by the customer may result in a reasonable rescheduling charge where one has been clearly disclosed and is fair in the circumstances.

20.5 JPC will not charge a customer merely because access failed where the failure was caused by JPC.

21. PETS AND ANIMALS

21.1 Customers must ensure that pets and other animals are safely controlled during Service Visits where reasonably required.

21.2 JPC may refuse to enter or work in an area containing an uncontrolled animal where there is a safety concern.

21.3 Customers must notify JPC of animals, ponds, livestock or other relevant hazards.

21.4 JPC will take reasonable care around known pets but cannot accept responsibility for an animal that escapes through an open gate where JPC has followed reasonable procedures, except to the extent caused by JPC's negligence or breach of contract.

22. CUSTOMER RESPONSIBILITIES

22.1 Customers must:

  • provide accurate information;

  • provide reasonable access;

  • identify known hazards;

  • remove or secure fragile items where reasonably required;

  • keep children and pets away from active work areas where requested;

  • disclose known underground services or hidden hazards;

  • disclose known drainage issues;

  • identify delicate surfaces;

  • comply with reasonable safety instructions; and

  • pay amounts properly due under the Membership Agreement.

22.2 Customers should remove vehicles from areas scheduled for power washing unless otherwise agreed.

22.3 JPC is not responsible for damage caused by concealed, undisclosed or pre-existing defects where such damage could not reasonably have been identified before work.

23. SURFACES AND PRE-EXISTING CONDITIONS

23.1 Cleaning may reveal defects or deterioration that were not obvious before cleaning.

23.2 Examples include:

  • loose blocks;

  • cracked paving;

  • failed pointing;

  • deteriorated tarmac;

  • damaged sealant;

  • unstable slabs;

  • loose render;

  • existing chips;

  • weak coatings;

  • old paint;

  • degraded surfaces; and

  • previously repaired areas.

23.3 JPC will take reasonable care when carrying out services.

23.4 However, JPC cannot guarantee that cleaning will not expose or worsen a pre-existing defect where the defect was not reasonably detectable beforehand.

23.5 JPC may decline to clean a surface where the foreseeable risk of damage is unreasonably high.

24. EQUIPMENT FAILURE

24.1 JPC may use professional machinery and equipment to provide the services.

24.2 Equipment can occasionally fail despite reasonable maintenance.

24.3 If equipment failure prevents a scheduled service, JPC will use reasonable efforts to rearrange the affected visit.

24.4 Equipment failure does not entitle JPC to simply remove an included service from the Membership without reasonable replacement, adjustment or other appropriate remedy.

24.5 Nothing in this clause limits statutory consumer rights.

25. WEATHER AND GROUND CONDITIONS

25.1 JPC may postpone work where weather or ground conditions make the work unsafe or likely to cause damage.

25.2 Examples include:

  • heavy rain;

  • flooding;

  • frost;

  • snow;

  • high winds;

  • extreme temperatures;

  • saturated ground;

  • unsafe surfaces; and

  • conditions unsuitable for chemical treatment.

25.3 JPC will use reasonable efforts to rearrange postponed work.

26. MEMBERSHIP COMMENCEMENT

26.1 The Membership will commence on the date stated in the Membership Agreement.

26.2 The 2027 service programme is expected to begin from March 2027.

26.3 This does not mean that every Member will receive their first Service Visit on 1 March 2027.

26.4 JPC will allocate individual service windows according to route planning and operational capacity.

27. PAYMENT AND DEPOSITS

27.1 The total Membership Price is £449 unless a different price is expressly stated in the Membership Agreement.

27.2 Where JPC requires a deposit, the Membership Agreement will state:

  • the deposit amount;

  • when it is payable;

  • whether it forms part of the total Membership Price;

  • when the balance is payable; and

  • the applicable cancellation/refund arrangements.

27.3 Unless expressly stated otherwise, a deposit forms part of the Membership Price and is not an additional charge.

27.4 JPC will not describe a deposit as non-refundable where doing so would conflict with applicable consumer law.

27.5 If a customer exercises a statutory cancellation right, refunds will be dealt with in accordance with the applicable law.

27.6 If a customer requests that service begins during a statutory cancellation period, JPC may be entitled to charge a proportionate amount for services supplied before cancellation where the legal requirements for doing so have been satisfied.

28. STATUTORY CANCELLATION RIGHTS

28.1 Where the Membership is entered into as a distance contract or off-premises contract and applicable law provides a statutory cancellation right, the customer will be entitled to exercise that right.

28.2 The applicable cancellation period will be explained in the pre-contract information supplied to the customer.

28.3 For a standard distance service contract, the statutory cancellation period is generally 14 days beginning on the day after the contract is entered into, subject to applicable legislation and any future changes in law.

28.4 A customer may exercise a cancellation right by making a clear statement to JPC that they wish to cancel.

28.5 JPC will provide the legally required information and cancellation arrangements applicable to the contract.

28.6 Where a customer asks JPC to begin providing services during the cancellation period, the customer may be required to pay a proportionate amount for services actually supplied before cancellation, where permitted by law.

28.7 Where a service has been fully performed following a valid express request to begin during the cancellation period and the customer has acknowledged the relevant legal consequences, statutory cancellation rights may cease where the law provides for that result.

28.8 Nothing in these Terms limits any statutory cancellation right.

29. CANCELLATION BY THE CUSTOMER AFTER THE STATUTORY PERIOD

29.1 After any applicable statutory cancellation period has expired, a customer may still request cancellation.

29.2 Where the customer cancels before the end of the Membership Year, the financial consequences will depend upon:

  • the terms of the Membership Agreement;

  • the services already supplied;

  • the stage of the Membership;

  • any applicable statutory rights;

  • any deposit or payment already made; and

  • the circumstances of cancellation.

29.3 JPC will act reasonably and fairly when considering cancellation and refunds.

29.4 JPC will not impose a cancellation charge that is disproportionate or otherwise unlawful.

29.5 Nothing in this clause removes a customer's statutory rights.

29.6 Cancellation and refund calculation: [FINAL REFUND/CANCELLATION FORMULA TO BE CONFIRMED FOLLOWING LEGAL REVIEW]. The final approved calculation will be recorded in your Membership Agreement. Your statutory consumer rights are not affected.

30. CANCELLATION BY JPC

30.1 JPC may cancel or terminate a Membership where there is a legitimate and reasonable basis to do so.

30.2 Examples may include:

  • serious or repeated abusive behaviour;

  • serious threats to staff;

  • deliberate property damage;

  • repeated non-payment;

  • unsafe working conditions;

  • materially false information supplied during application;

  • the Property materially changing so that the agreed services can no longer reasonably be provided;

  • repeated refusal to provide reasonable access;

  • serious interference with JPC's equipment or staff; or

  • circumstances making continued performance unlawful or unsafe.

30.3 Where JPC terminates a Membership, JPC will consider whether a refund is due for services not supplied.

30.4 JPC will not use termination rights unfairly to avoid providing services already paid for.

30.5 Where termination is caused by JPC's own failure to provide the contracted services, appropriate remedies may include rescheduling, repeat performance, price reduction or refund, depending upon the circumstances and applicable law.

31. SERVICE QUALITY AND CONSUMER RIGHTS

31.1 JPC will provide the contracted services with reasonable care and skill as required by applicable consumer law.

31.2 Where information about the service has been provided to the customer and forms part of the contract under applicable law, JPC will provide the service in accordance with that information.

31.3 Where the service does not conform to the contract, the customer may have statutory remedies.

31.4 Depending upon the circumstances, those remedies may include repeat performance or a price reduction.

31.5 Nothing in these Terms removes or limits statutory rights.

32. LIMITATION OF LIABILITY

32.1 Nothing in these Terms excludes or limits liability where doing so would be unlawful.

32.2 In particular, JPC does not exclude or limit liability for:

  • death or personal injury caused by JPC's negligence;

  • fraud or fraudulent misrepresentation;

  • breach of statutory rights that cannot lawfully be excluded;

  • any liability which cannot lawfully be excluded or limited.

32.3 Subject to clause 32.2, JPC will not be responsible for loss caused solely by:

  • the customer's failure to disclose a known hazard;

  • a pre-existing defect;

  • concealed conditions that could not reasonably have been identified;

  • inaccurate information supplied by the customer; or

  • the customer's failure to follow reasonable instructions,

except where JPC's own negligence, breach of contract or other legal responsibility contributed to the loss.

32.4 JPC will take reasonable care to avoid foreseeable damage to property.

32.5 Customers should inform JPC of particularly valuable, fragile or sensitive property before work begins.

32.6 Nothing in this clause prevents a consumer from exercising a statutory remedy.

33. DAMAGE TO PROPERTY

33.1 If a customer believes JPC has caused damage, they should notify JPC as soon as reasonably practicable.

33.2 JPC may request photographs, inspection or other reasonable information to investigate the issue.

33.3 JPC will investigate genuine complaints fairly.

33.4 Where JPC is responsible for damage, JPC will consider an appropriate remedy in accordance with the circumstances and applicable law.

33.5 JPC is not responsible for damage that was not caused by JPC.

34. WASTE AND GREEN WASTE

34.1 Ordinary grass cuttings generated by included lawn cutting will be dealt with in the manner stated in the Property Service Schedule or agreed with the customer.

34.2 Large amounts of garden waste, hedge waste, branches, soil, rubble or other material are not automatically included.

34.3 Waste removal may be quoted separately.

35. ACCESS TO WATER AND ELECTRICITY

35.1 Where reasonably required, JPC may request access to a suitable external water supply.

35.2 Customers should inform JPC in advance if no suitable water supply is available.

35.3 JPC may use its own equipment where practical.

35.4 Customers must not provide unsafe electrical supplies or damaged equipment.

36. CHEMICAL AND ENVIRONMENTAL SAFETY

36.1 JPC will take reasonable steps to use cleaning and treatment products appropriately.

36.2 Products will be used in accordance with applicable legal requirements and manufacturer instructions.

36.3 Customers must disclose sensitive environmental features such as ponds, watercourses, fish or vulnerable vegetation.

36.4 JPC may postpone or refuse a treatment where environmental or weather conditions make it inappropriate.

36.5 Customers must not interfere with or move chemical-treatment equipment or warning arrangements during a treatment.

37. PHOTOGRAPHS AND RECORDS

37.1 JPC may take photographs of completed work for operational records, quality control, complaint investigation and insurance purposes.

37.2 Photographs will be handled in accordance with applicable data-protection law.

37.3 JPC will not use identifiable photographs of a customer's property for public marketing without an appropriate lawful basis and, where required, consent.

38. DATA PROTECTION

38.1 JPC will process personal information in accordance with applicable UK data-protection legislation.

38.2 Personal information may be used for purposes including:

  • processing Applications;

  • carrying out Assessments;

  • administering Membership;

  • scheduling Service Visits;

  • communicating with customers;

  • processing payments;

  • dealing with complaints;

  • maintaining business records;

  • meeting legal obligations; and

  • protecting JPC's legitimate business interests where lawful.

38.3 JPC will provide further information in its Privacy Notice.

38.4 Marketing communications will be handled in accordance with applicable data-protection and electronic-marketing laws.

38.5 Customers may withdraw marketing consent or object to direct marketing where applicable.

39. MARKETING

39.1 JPC may contact Members about their Membership, scheduled services, operational information and other service-related matters.

39.2 Marketing communications are separate from necessary service communications.

39.3 JPC will only send direct electronic marketing where there is an appropriate lawful basis under applicable law.

39.4 Customers may opt out of marketing communications.

40. COMMUNICATIONS

40.1 JPC may communicate using:

  • email;

  • telephone;

  • SMS;

  • messaging services;

  • the JPC website; or

  • other contact details supplied by the customer.

40.2 Customers must keep their contact information reasonably up to date.

40.3 Customers should check communications concerning scheduled visits and Membership administration.

40.4 JPC will not treat silence as acceptance of a material variation to the contract where the law requires express agreement.

41. MEMBERSHIP CHANGES

41.1 JPC may make reasonable operational changes to the way services are delivered where necessary.

41.2 JPC will not materially reduce the contracted services without appropriate agreement or legal justification.

41.3 If a proposed change would materially affect the customer's rights or the substance of the Membership, JPC will communicate the change clearly and, where required, obtain the customer's agreement.

41.4 JPC may correct minor administrative errors provided that doing so does not adversely alter the customer's contractual rights.

42. TRANSFER OF PROPERTY / MOVING HOME

42.1 Membership is attached to the Property and is not automatically transferable to another property.

42.2 If a Member moves home during the Membership Year, they must notify JPC.

42.3 JPC may, at its discretion, assess the new property for possible continuation or transfer.

42.4 Transfer is not automatic because the new property may have different:

  • lawn size;

  • hard-surface area;

  • access;

  • travel requirements;

  • service requirements; or

  • workload.

42.5 If the new property is unsuitable, the original Membership will be dealt with in accordance with the cancellation and refund provisions applicable to the circumstances.

43. MEMBERSHIP DOES NOT AUTOMATICALLY RENEW

43.1 The standard 2027 Membership is a fixed-term Membership for the Membership Year stated in the Membership Agreement.

43.2 The Membership does not automatically renew.

43.3 JPC may invite Members to apply for a subsequent year's Membership.

43.4 A new Membership Year requires a new agreement or other legally compliant renewal process.

43.5 JPC will not automatically take another annual payment without the appropriate contractual basis and any legally required consumer information or renewal process.

44. FUTURE SUBSCRIPTIONS OR AUTOMATIC RENEWAL

44.1 If JPC later introduces automatic renewal or recurring payments, JPC will review and update its contractual and operational procedures before doing so.

44.2 Any automatic-renewal arrangement will comply with applicable law at the time it is introduced.

44.3 JPC will provide any required pre-contract information, cancellation arrangements, reminder notices and other legally required information.

45. FORCE MAJEURE / EVENTS OUTSIDE REASONABLE CONTROL

45.1 JPC will not be responsible for delay caused by circumstances genuinely outside its reasonable control, including:

  • severe weather;

  • flooding;

  • major storms;

  • serious road disruption;

  • government restrictions;

  • major utility failures;

  • serious equipment supply disruption;

  • serious illness;

  • industrial action;

  • or other exceptional circumstances.

45.2 JPC will nevertheless take reasonable steps to minimise disruption and resume services as soon as reasonably practicable.

45.3 This clause does not automatically remove a customer's right to a remedy where applicable law requires one.

46. COMPLAINTS

46.1 JPC wants complaints resolved quickly and fairly.

46.2 Customers should initially contact JPC using the contact details in the Membership Agreement.

46.3 A complaint should, where possible, include:

  • customer name;

  • Property address;

  • date of Service Visit;

  • description of the issue;

  • photographs where relevant; and

  • desired outcome.

46.4 JPC will investigate complaints reasonably and respond within a reasonable period.

46.5 Where a complaint concerns damage, customers should notify JPC as soon as reasonably practicable so that an inspection can be arranged.

47. ALTERNATIVE DISPUTE RESOLUTION

47.1 JPC will seek to resolve disputes directly with customers wherever possible.

47.2 If an appropriate alternative dispute resolution provider or scheme applies to the dispute, JPC will provide the relevant information where legally required.

47.3 Nothing in these Terms prevents a consumer from exercising their legal rights or bringing proceedings where appropriate.

48. INTELLECTUAL PROPERTY

48.1 JPC retains ownership of its:

  • branding;

  • logo;

  • website content;

  • photographs;

  • written materials;

  • pricing structures;

  • service documentation; and

  • other intellectual property,

except where ownership belongs to another party.

48.2 Customers may not reproduce JPC materials for commercial purposes without permission.

49. THIRD-PARTY CONTRACTORS

49.1 JPC may use appropriately selected third parties where reasonably necessary to provide or support the services.

49.2 JPC remains responsible for the contractual services it has agreed to provide to the customer, subject to these Terms and applicable law.

49.3 JPC may use specialist contractors for work that falls outside the Membership where agreed with the customer.

50. INSURANCE

50.1 JPC will maintain such business insurance as it considers appropriate for its operations.

50.2 Insurance does not replace or restrict a customer's statutory rights.

50.3 Nothing in these Terms makes the customer responsible for losses caused by JPC where JPC is legally responsible for those losses.

51. NO WAIVER OF STATUTORY RIGHTS

51.1 Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded or restricted.

51.2 If any provision conflicts with mandatory consumer legislation, the mandatory legislation will prevail to the extent of the conflict.

51.3 Any unlawful or unenforceable provision will be treated as modified or removed to the minimum extent necessary, while the remaining provisions continue where legally possible.

52. FAIRNESS AND TRANSPARENCY

52.1 These Terms are intended to be written in plain and understandable language.

52.2 JPC will not rely on a term in a manner that would be unfair or contrary to applicable consumer law.

52.3 Where a term is capable of more than one reasonable interpretation, JPC will seek to interpret and apply it fairly and consistently with applicable law.

53. ENTIRE AGREEMENT

53.1 The Membership Agreement, Property Service Schedule and these Terms form the contractual framework for the Membership.

53.2 Nothing in this clause excludes information which is legally required to form part of the contract.

53.3 JPC will not rely on this clause to exclude a representation or information that is legally binding under applicable law.

54. GOVERNING LAW

54.1 These Terms and the Membership contract are governed by the law applicable in Northern Ireland.

54.2 The courts of Northern Ireland will have jurisdiction, subject to any mandatory consumer rights concerning jurisdiction or applicable law.

54.3 Nothing in this clause prevents a consumer from exercising any mandatory rights they have under applicable law.

55. CHANGES TO THESE TERMS

55.1 JPC may update these Terms from time to time.

55.2 Changes will not automatically alter an existing customer's contractual rights unless the change is permitted under the existing contract or agreed with the customer.

55.3 The version applicable to a Membership will normally be the version supplied to the customer before the Membership contract was entered into.

55.4 JPC may update policies for future Membership Years.

56. ONLINE ACCEPTANCE

56.1 Where the Membership is entered into online, the customer may be asked to confirm that they have read and agree to the Membership Agreement and these Terms.

56.2 The customer should be given reasonable access to the Terms before entering into the contract.

56.3 JPC will retain reasonable records of contractual acceptance where appropriate.

56.4 A checkbox does not remove statutory consumer rights.

57. CUSTOMER CONFIRMATION

Before Membership activation, the customer may be required to confirm:

I confirm that I have read and understood the JPC 2027 Property Care Membership Terms & Conditions and my Property Service Schedule. I understand that the Membership covers only the services and areas specifically identified for my property and that additional work may be quoted separately.
